Request for Public Records
Public Records Requests, Subpoenas and Summons Town Wide
Chapter 119 of the Florida Statutes governs public records. The Town Clerk’s Office is responsible for receiving and processing all public records requests, law firm requests, summons, and subpoenas for the Town. To ensure accuracy, and track progress, it is recommended that public records requests be made in writing. When making a public records request, be as detailed as possible. The Town Clerk’s Office will respond to all public records requests in a reasonable time, based on the extent and nature of the request.
Cost of duplicating records:

The Town Clerk’s Office will notify the requestor the estimated time to fulfill a request, an estimated cost and if a deposit is required in advance as determined by the nature or volume of the records request if it requires extensive use of resources as governed by Florida Statute 119.07(4)(d). Extensive resources is defined as time consumption over fifteen minutes. The Town of Davie has a thirty minute threshold. When a public records request will take more than thirty minutes, the Town of Davie enacts the special service charge allowed under F.S. § 119.07(4)(d) which allows for public agencies to charge a special service charge when the records requested require extensive resources.

Patient Care Reports and Fire or Inspection Reports
State and Federal laws prohibit us from providing medical records due to medical privacy laws and other exemptions. To ensure compliance with the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the Standards for Privacy of Individually Identifiable Health Information (45 CFR Part 160 and 164), medical information covered by the patient/physician privilege may be released only if the request is accompanied by *one of the following properly authenticated release:
- A valid authorization to disclose the PHI signed by the target of the subpoena;
- A certificate of compliance from the attorney that contains all of the requirements under HIPAA; or
- A court order for the release of the requested information.
*Other legal forms of documents as permitted by State or Federal law may be accepted on a case by case basis.

In accordance with Florida Statute Chapter 119, public records requests will be produced within a "reasonable time" based on the extent of the request.
